Dear Chief Officer
Part I of the Criminal Justice Act 2003 introduced some key new police powers and procedures as well as a number of important amendments to the Police and Criminal Evidence Act 1984 (PACE). This Circular deals with the following sections of the Act:
Section 1: Extension of powers to stop and search
Power to stop and search now includes articles made, adapted or intended for use in criminal damage
Section 2: Warrants to enter and search
Authorised people accompanying a constable allowed the same powers of execution and seizure
Section 4: Bail elsewhere than at a police station

Section 6: Use of telephones for reviews of police detention
Enables reviews of detention without charge to be conducted by telephone rather than in person
Section 7: Limits on periods of detention without charge
Extends the maximum time of detention for an arrestable offence from 24 to 36 hours
Section 8: Property of detained persons
Removes absolute requirement to make detailed records of a detained person's property
Section 11: PACE Codes of Practice
Enables simpler, less bureaucratic and more frequent update and review of Codes
These measures come into force on 20 January 2004 and take forward recommendations contained in the Cabinet Office/Home Office PACE Review (http://www.homeoffice.gov.uk/docs/pacereview2002.pdf). The 2003 Act also impacts on other parts of PACE. Paragraph 6.1 sets out progress on guidance for other PACE-related provisions of the Act.
