Public Consultation on the Section 12 and 13 Orders for the Regulation of Investigatory Powers Act 2000

The consultation is for two pieces of secondary legislation:

  • The Regulation of Investigatory Powers Act 2000 (RIPA) states that the section 12 order will define the reasonable interception capability a Communication
    Service Provider (CSP) will maintain should they be served with a section 12 notice.
  • Section 13 of the Regulation of Investigatory Powers Act 2000 (RIPA) requires the creation of a Technical Advisory Board (TAB). The Act provides that the Board’s functions are to consider the reference to them by a communication service provider (CSP) of any notice served on that CSP under section 12, and to report their conclusions to the CSP and to the Secretary of State.
