DBOs on conviction
Drinking banning orders (DBOs) on conviction came into force on 1 April 2010 in 25 local justice areas (LJAs) and were extended to a further 25 LJAs on 1 November 2010. All 50 areas are listed below.
Any magistrates’ court sitting in these LJAs will be able to impose a DBO on anyone convicted of an offence committed while they were under the influence of alcohol.
The court must consider applying DBOs on conviction in criminal proceedings, in addition to any other sentence or conditional discharge imposed.
Whether the offence was committed while under the influence of alcohol will be a matter for the courts to determine, based on the circumstances of each individual case.
There is no requirement for the police or local authority to make an application to the court for a DBO on conviction.
While it is for the court to determine whether or not it is going to make a DBO, the prosecution will need to decide whether they are going to lay extra evidence in support of the consideration of the DBO.
It is important to note that for an individual to be issued with a DBO on conviction in the areas below, they must have committed the offence on or after 1 April 2010, or on or after 1 November 2010 as applicable.
