Criminal Justice Act 1991
Section 95

(1) The Secretary of State shall in each year publish such information as he considers expedient for the purpose of:

(a) enabling persons engaged in the administration of justice to become aware of the financial implications of their decisions; or

(b) facilitating the performance of such persons of their duty to avoid discriminating against any persons on the ground of race or sex or any other improper ground.

(2) Publication under subsection(1) above shall be effected in such a manner as the Secretary of State considers appropriate for the purpose of bringing the information to the attention of the persons concerned.

Review of the S95 statistics on Race and the Criminal Justice System

The CJS Race Unit, a trilateral unit of the Home Office, Department of Constitutional Affairs and Crown Prosecution Service, is conducting a root and branch review of the statistics on Race and the Criminal Justice System, published under S95 of the Criminal Justice Act 1991. These statistics are published by the Research Development and Statistics Directorate. The CJS Race Unit has commissioned Chris Lewis and Tom Ellis from Portsmouth University to carry out the review. It will consider what statistics should be collected, how they should be collected and disseminated, and how they can be developed into a better tool for use.

Developing statistics that drive change: Implementing the Root and Branch Review of the Race and Criminal Justice System Statistics

The race and criminal justice system statistics published under section 95 of the 1991 Criminal Justice Act are one of the main sources of information available on Black and Minority Ethnic groups' experiences across the criminal justice system, however since they were first published in 1992 they have developed incrementally. The Root and Branch Review, commissioned by the CJS Race Unit, OCJR, is the first time there has been a systematic examination of their collection, dissemination and use in the light of policy and legislative developments. Based upon the review the CJS Race Unit will be taking forward a major programme of work to develop the current statistics into a comprehensive set of management information that can be used drive performance in relation to race issues across the criminal justice system.
